Burkett Terms & Conditions

Please read these terms and conditions carefully. By proceeding with your order, you acknowledge your full understanding of, agreement to and acceptance of these terms and conditions.

INTRODUCTION

A. Except in those instances where Burkett Restaurant Equipment & Supplies ("we", "us", "Burkett") and a business Customer enter into a separate written contract for the purchase of Products providing for separate terms of sale, the following terms and conditions (the “Conditions”) apply.
B. These terms and conditions take precedence over Buyer's supplemental or conflicting terms and conditions to which notice of objection is hereby given.
C. Burkett shall be entitled to amend the terms and conditions without notice.
D. These Conditions hereby incorporate by reference our Privacy Policy, Burkett Return and Exchange Policy, and Used Equipment Guarantee with 90-Day Parts and Labor Warranty.

WEBSITE INFORMATION

1.1 Despite our efforts, occasional pricing errors may occur on the Burkett website, and we reserve the right to correct or change such pricing errors without notice. Burkett further reserves the right to cancel any and all orders resulting from such pricing errors, even if Customer has received an order confirmation from Burkett. In the event of an erroneous price or description, the customer will be contacted to confirm corrections as quickly as possible.
1.2 Burkett is a distributor of products. Information about the products on the Burkett website is provided by the manufacturers and/or suppliers. We work closely with our manufacturers and suppliers to provide up-to-date and accurate information; however, there are instances where we cannot obtain an exact description or photo of a product. Product depictions are for illustrative purposes only.
1.3 Burkett reserves the right to correct or change publishing errors.

PRICES & PAYMENT

2.1 "Web prices" displayed on Burkett.com: (i) are available for orders placed on Burkett.com, by phone, or at our Perrysburg, OH showroom store; (ii) do not include installation, freight or taxes; and (iii) are subject to change or correction at any time and without notice. In the event of an erroneous price or description, the customer will be contacted to confirm corrections as quickly as possible.
2.2 Credit cards will be charged upon placement of order. You may pay for your order using the payment methods available, including cash, checks, money orders, American Express, Discover, MasterCard, Visa, PayPal and affordable leasing options. Customers Approved for Terms may submit a purchase order for processing (see application for details). Orders cannot be processed until payment is collected or payment requirements are achieved.
2.3 Sales tax will be charged on orders shipping to the states of Arkansas (AK), California (CA), Colorado (CO), Georgia (GA), Illinois (IL), Indiana (IN), Iowa (IA), Kentucky (KY), Maryland (MD), Michigan (MI), Minnesota (MN), Nevada (NV), New Jersey (NJ), New Mexico (NM), New York (NY), North Carolina (NC), Ohio (OH), Oklahoma (OK), Pennsylvania (PA), South Carolina (SC), Utah (UT), Virginia (VA), Washington (WA), Wisconsin (WI) and Washington, D.C. and will be calculated during checkout. If you are tax exempt and shipping to one of these States, please email a copy of your tax-exempt form to accounting@burkett.com.

PRODUCT AVAILABILITY

3.1 Same Day: Same Day Shipping: Same day shipping items will ship SAME DAY if your order was processed before 2:30 PM EST, otherwise they will ship within 1 business day of order processing.
3.2 Quick Ship: In-stock Products generally ship in 1-3 business days unless otherwise stated.
3.3 Factory Direct Shipments: Some of our products ship directly from the manufacturer and will not be included with products that are shipping from our warehouse.
3.4 Burkett's Distribution Center performs at a very high order fill rate. However, we may on occasion have limited or no availability due to an item being discontinued by the manufacturer, or an item being on backorder due to increased demand. We try to fulfill every order in a timely manner and will work with you to replace or substitute items that are unavailable. In the event a standard item is backordered:

  • In the event of backorder, customer will be contacted. Estimated lead time will be provided when available. Substitute or alternate items will be recommended when available.
  • Shipping and Handling: Once available and released for shipping, backordered product will ship immediately. Backorders will ship under the original agreed freight amount. If the original order qualified for free freight, the backorder will ship free. In the unlikely event there is more than one backordered item, Burkett will ship all backorders together in one shipment.

SHIPPING

4.1 Your Shipment Confirmation will contain information on the carrier and the associated tracking number(s) once your order is dispatched.
4.2 Burkett cannot be held responsible for unanticipated delivery delays beyond our control.
4.3 Items sold with Same Day Shipping will ship on the day the order was placed, if the order is processed before 2:30 PM EST, otherwise they will ship within 1 business day of order processing.
4.4 Items sold with Quick Ship will ship within 3 business days.
4.5 Standard lead times noted on the Website indicate the expected timeframe for shipment, do not include transit time, and are not a guarantee of shipment. A Burkett representative will contact you if extended delays are expected.
4.6 Projects or special orders may have a negotiated lead time. Final lead times will be reviewed and agreed upon at the time order is placed.
4.7 If you do not have an elevated loading dock or forklift to unload your items, you must select liftgate at checkout. A higher fee may apply if a liftgate must be added after an order has shipped.
4.8 Carriers charge a fee to ship to a residential address. This fee varies by region and will be reflected in your shipping charges.

CUSTOMER DELIVERY INSPECTION - STOP. INSPECT. ACCEPT/REJECT.

5.1 When a product is delivered, it is the responsibility of the recipient to unpack and inspect the product prior to signing. Unpack and inspect Product(s) prior to signing for them. Failure to inspect your Product(s) before signing may result in your inability to process a repair claim for the damaged product or a warranty claim for a defective product.

WHITE GLOVE DELIVERY SERVICE

6.1 "Web prices" displayed on Burkett.com: (i) are available for orders placed on Burkett.com, by phone, or at our Perrysburg, OH showroom store; (ii) do not include installation, freight or taxes.
6.2 Burkett Installation service includes delivery of all equipment and supplies to job site, uncrate, set in place and trash removal. Customer is responsible for final connections through certified professional.
6.3 Delivery price is based on non-union labor. Union labor pricing can be provided upon request.
6.4 Unless otherwise noted, pricing does not include installation of the hood or walk-in unit.
6.5 Please contact a Burkett Sales Representative to review delivery services available.

WARRANTY

7.1 All new product warranty claims are handled based on the manufacturer’s warranty policy and may or may not apply for residential use.
7.2 All used product warranty claims are handled based on Used Equipment Guarantee and 90-Day Parts and Labor Warranty located on Burkett.com or through Burkett's Sales Representative.

BURKETT USED EQUIPMENT GUARANTEE

8.1 The Burkett Used Equipment Program is our proprietary repair and restoration process. Our skilled technicians and rigorous Quality Assurance testing ensure all equipment operates in accordance with manufacturer's recommended use. We reserve the right to use after-market, used, reconditioned or non-OEM parts in any used or reconditioned product.
8.2 Products marked as used or reconditioned may have been previously used and may come with scratches, dents, cosmetic defects, or general wear and tear that is not covered by warranty and is ineligible for freight damage claims or warranty repair.
8.3 Product pictures posted online should be considered as guidelines and may not show every dent or scratch. You have the right to obtain a detailed explanation or additional pictures of a Product before you purchase.
8.4 In the unlikely event you have a problem with your purchase, we've provided the security of our Used Equipment Guarantee with 90-Day Parts and Labor Warranty.
8.5 Please refer to Read Me First document provided with your Product for detail on repair and requirements for installation. To qualify for the Burkett Warranty your equipment must be installed by a certified food service equipment technician if it has any of the following components; gas, water, 208V or higher, or a 3-Phase Electrical connection.
8.6 This warranty is not applicable for residential use.

RETURNS & EXCHANGES

9.1 Our goal is customer satisfaction. You can take advantage of the Burkett 30 Day Return and Exchange Policy. Please refer to the Burkett Return and Exchange Policy for more information.
9.2 All returns must be unopened, unused and in the original packaging material to be accepted.
9.3 Any order or items cancelled or returned after the original approved sales order will be subject to vendor restocking fee minimum 20%, plus return shipping if the Item has been shipped by Burkett or Vendor, including special order items received by Burkett.

PRIVACY

10.1 Burkett is committed to protecting your privacy. Please refer to our Privacy Policy for more information about the collection and use of customer information.

LIMITATION OF LIABILITY

11.1 The total amount of Burkett's liability, in respect of the purchase of Products under these Conditions, is limited to the amount paid by the Buyer for the purchase of the Product.
